I'm saying he "can't" in terms of being a viable candidate. There is too much political fallout. He'll lose endorsements and votes. There is nothing forcing him out, as the article said. I'm just saying, being a convicted felon weighs heavily against the goal of his.

I read it, but you're misinterpreting what I said. I just meant that the guy would have a hard time winning the seat as a convicted felon. Not that he was required to drop out of the race. States do it different ways I guess. Still, they wouldn't have been able to replace Stevens on yesterday's ballot due to time contrainsts. So, from an Alaskan Republican perspective, it's probably better to force a resignation and a special election with a chance of a different Republican winning, than to cede the election outright to Begich.

From a pure partisanship perspective, that seems like a logical course of action.

Sorry I haven't been around for this one, but I've been busy fighting with conspiracy-theorists. How could you say an election is "stolen" when 1/3 of the votes weren't yet counted?

Anyway, here's the latest from yesterday's vote (cut-and-pasted from the blog and a hot item on BuzzFlash today):

Region 2: Mat Su Valley--DONE

Anchorage will be finishing their count on Tuesday Nov. 18th as well.

Region 3: Prince William Sound--DONE

Region 4: Aleutians, Western AK, North Slope--DONE

There are about 25,000 votes yet to count between Anchorage and Juneau. As Begich is mayor of Anchorage and "questioned ballots" ("provisional" to some of you) generally break Dem, it's a good bet that he'll pull much farther ahead from the Anchorage vote. Juneau early votes broke for Mark by 63% so that's also a good bet.

However, no one is counting any chickens...especially not the campaign.

I was at the Begich office and the Division of Elections in Anch for the count this past week and took pictures (story on the blog, of course). I'll be back there on Tuesday.

Target certification will be the week of December 1, as soon as the State Review Board has completed their review the director certifies the election.

With the margin of 3,724 votes, the likelihood of a recount has been reduced, since it would have to be paid for by the Stevens campaign. The only time there is an automatic recount is when there is a tie. If the final vote is within 0.5 percent, a recount can be requested, and the state will cover the bill. If the final vote is more than 0.5 percent (+/- 1,600), a campaign can request a recount, but would have to pay for it. A recount may be applied for within 5 days of certification, by either the defeated candidate or 10 members of the defeated candidate's party. If a recount application is filed immediately, the Division of Elections must commence within five days of receipt of an application. A recount is done by machine in Juneau for the entire state, and would take approximately 3 - 5 days.

perhaps my old terminology is wrong, however, he was a beloved figure in his state, and the democratic campaign waged war on him over his corruption trial and conviction, and yet still only won by 3700 votes or so.

I'm saying that had any sort of vindication of this level come out before the election, I'd be willing to wager that Stevens would have won re-election.

Now, like I stated, I'm not saying that this dismissal of judgement actually vindicates him in my mind completely, good chance he is probably guilty of some part of this crime if not all, but it still puts a taint is some way on the election process at least to me.

I don't see how there's any shred of a taint on the election process. Bush appointees ran the case from start to finish. No one is suggesting that Steven's isn't corrupt, just that the prosecution was structurally flawed.

If anything, it just spreads the taint of the Bush DoJ around even further.
