Actually, that copyright notice is worrisome. Some lawyer just got a judge to uphold a copyright on a cease & desist letter, theoretically preventing it from being posted online anywhere. I can't imagine that'll continue to hold up though.

Okie dokie. I've read the opinion presented on this "Dozier" site. Ideally I'd like to have had a proper citation to a case, but alas we've already established that I'm lazy.

Unless someone can point to another, more conclusive opinion, I'd say you all are getting way ahead of yourselves. This opinion rejects a motion to quash - there's no final judgment made here. It's a minor setback for the copyright defendant at worst, but admittedly closer to trial, which can get expensive I guess. The judge did not reach the merits of the case and didn't even try to explain them at any meaningful level. Even assuming it gets to trial, my money's on the defendant still. Even assuming the plaintiff wins at trial, it's still a pissant court in Idaho under the 9th district, an appellate court that damn well knows copyright law and could tear an incompetant judgment to shreds.

I don't claim to be an expert on copyright, but a good judge can smell a meaningless ploy a mile away. And about the 3 posts in a row: bite me :D I like to ruminate.

Regardless, the information you all were working from seems to be skewed, at best. Despite what you all might think, random websites pulled from Google aren't exactly a high fidelity source of information on much of anything, let alone the law. It's actually a problem endemic to most of your posts Tarot; a wikipedia-level understanding of the world. Honestly I wasn't asking entirely for my own benefit. I may not be a 30-year practitioner, but I've read my share of trial records and briefs. Notwithstanding the fact that I can't give anyone any kind of advice here, I think that I still have a lot of value to add to a discussion involving the law. There's a lot more there than you probably appreciate.

Might want to work on your reading skills there. "You all" is a single person who brought up the copyright issue. They weren't even the person who provided the link, which if you're actually concerned about the quality of a source (lolz) you'd have asked them directly and awaited their response. Despite what "you all might think" is even more self important nonsense.

As it was, that case happened to be in the mainstream media for days, a simple google search (C&D copyright) would have found you enough information to follow it further. You were being lazy. Of course that's giving you the benefit of the doubt, you might just be that stupid. I'd certainly hope anyone using this board isn't that much of a failure on how to use a search engine, but I suppose it's possible.

As far as that actual topic, you've offered nothing of worth. You didn't even bother to thank the person who went out of their way to provide a link, you simply bitched about the manner in which it was provided while repeatedly tooting your own horn. Normally that might end up as some quality entertainment as a few people hand you your ass, but it's been slow around here.
